In a significant legal triumph, Dr. Simone Gold, founder of America’s Frontline Doctors (AFLDS), successfully defended her medical license against the California Medical Board (CMB), with the support of her legal team.
The CMB had accused Dr. Gold of unprofessional conduct related to her January 6, 2021, Capitol involvement, where she pleaded guilty to a misdemeanor charge of entering a restricted building, serving a 60-day sentence.
The CMB sought to revoke her license, alleging her actions reflected poorly on her professional judgment, and, despite having no proof tying her personal actions with her professional obligations under the board, they claimed that these actions were in fact “substantially related to the qualifications, functions, or duties of a physician.”
After the initial hearing, an Administrative Law Judge ruled in her favour, confirming that CMB did not have the right to remove her license, however they agreed with CMB regarding her actions on January 6th, stating that Dr. Gold should be publicly reprimanded by the board and have to undergo medical ethics training.
This outcome was appealed through the Supreme Court of California where Judge Michael T. Smyth failed to find any such connection between her actions on J6 and her role as a physician and thus, no grounds for discipline. The previous recommendations for reprimand and ethics training were removed. In addition, Dr. Gold was awarded financial relief for litigation costs which CMB will now be required to pay.
Fully vindicated, Dr. Simone Gold is free again to continue her practice. It is unknown at this time, whether the CMB will attempt to appeal the decision.
In response to the ruling, Dr. Gold stated, “The initial trial verdict was a victory by any definition. I appealed because what the government did was wrong. The California Medical Board has absolutely no authority to sanction doctors for nonmedical misdemeanors. George Washington warned us about usurpation and the courts must hold these executive agencies accountable. I am thankful for my excellent attorneys who believed in my vision for victory. I have been vindicated and together we have set a historic precedent for any licensed professional battling usurpation in the future.”
Dr. Gold points to this victory as a safeguard for doctors’ free speech and ethical patient care, emphasizing her commitment to challenging medical tyranny. She criticized the CMB for wasting taxpayer money on a baseless witch-hunt, further reinforcing her role as a civil liberties advocate.
Dr. Gold continues to lead AFLDS in its mission for medical freedom and transparency.
This case carries significant implications for the constitutional rights of all medical professionals, particularly the First Amendment right to free speech. The board’s attempt to discipline her was based solely on her political actions and public statements and had nothing at all to do with her exemplary record as a physician.
The broader implications of this case will continue to support a physicians’ rights to express controversial views without professional repercussions, further reinforcing that licensing boards cannot penalize doctors for constitutionally protected activities, such as political speech or protest, absent direct harm to patients.
We applaud Dr. Gold and her legal team for their tenacity, for standing strong in support of those who may also wish to speak out but have not, for fear of reprimand. Now is your chance – join those like Dr. Gold and AFLDS in speaking up for medical freedom and transparency.
